THE RULES OF THE MACHRIHANISH GOLF CLUB
Revised at the AGM on 07.04.2018
The club shall be called ‘THE MACHRIHANISH GOLF CLUB’ and shall be primarily devoted to the Game of Golf and shall be a non-profit making body dedicated to the supply of sporting services.
The object of the Club is to provide facilities for and promote participation of the whole community in the sport of golf.
MANAGEMENT OF THE CLUB
I The management of the Club shall be vested in a Committee of Eleven Members (including the Captain for the time being, the Vice-Captain if appointed and the Ladies Captain if appointed, provided that she is a Full Member failing which she shall be an observer only at committee meetings). The Captain shall be appointed yearly at the Spring General Meeting of the Club, and a Vice-Captain may be appointed at any General Meeting of the Club to hold office till the next Spring General Meeting. The other Members of Committee shall be elected by the Members of the Club at the Spring General Meeting and shall, save as provided in Rule II(c), hold office for three years. At the Spring General Meeting the three senior ordinary Members of Committee shall retire and shall not be eligible for re-election until the lapse of a year from their retirement. Not withstanding this rule, in exceptional circumstances, on the recommendation of the Committee, the Spring General Meeting shall have power, by a majority of three-fourths of those present and voting, to re-elect any Member whose turn it is to retire.
II The vacancies in the Committee shall be filled up in the following manner:
- Any two Members of the club shall be entitled to nominate a Member to serve on the Committee, having previously received the assent of such Member. The name of each Member so nominated shall be sent in writing to the Secretary fourteen days at least before the Spring General Meeting.
- A list of the names in alphabetical order shall be affixed to the Notice Board in the Club Room for ten days before the Spring General Meeting. Balloting lists shall be printed containing the names of the Candidates only, and from these lists each Member present shall vote for not more than sufficient Candidates to fill the vacancies. In case there shall not be a sufficient number of Candidates nominated, the Committee shall fill up the remaining vacancies. If any Member declines to serve, the Member who has the next largest number of votes shall be elected.
- If any Candidates tie for the last available vacancy, or vacancies, the Committee shall select by lot from such Candidates the Candidate or Candidates who are to be members of the Committee. Any vacancy occurring in the Committee during the year shall be filled up by the co-option of a Member by the Committee and the Member so co-opted shall hold office until the Spring General Meeting, when the vacancy will be filled by the Members of the Club by election.
- Employees of the Golf Club or persons employed by employees of the Golf Club are not eligible to serve on any committee of The Machrihanish Golf Club.
- The Lady Captain of The Machrihanish Golf Club, providing she is a Full Member of the Club, is automatically elected to be a member of the golf club committee during her serving year.
III (a) The Committee (three to form a quorum) shall have power to sub-commit and appoint Conveners. The Captain and Vice-Captain if any, shall be Members of all Sub-Committees.
- The Committee are empowered to make from time to time such Regulations or
Bye-laws consistent with the General Rules of the Club as they shall think necessary; and all Regulations made by the Committee, and orders given by them, shall be binding on every Member until set aside by a General Meeting of the Club. The Committee shall post up in the Club Room any Regulations made by them and shall report the same to the first General Meeting of the Club.
(c) The Committee shall have power to appoint a salaried Secretary upon such terms as they think fit
(d) No Member of the Committee and no manager or servant employed in the Club shall have any personal interest in the sale of excisable liquors therein or in the profits arising from such sale.
- The Committee shall meet as often as is necessary for conduct of the affairs of the Club, but in any case, at least once every three months.
- No Member of Committee or office bearer shall rent or lease land to the Club. No Member of Committee or office bearer shall be a relative, business partner or person acting under the direction of any person leasing or renting land to the Club.
IV (a)The Secretary shall keep full and correct minutes of all proceedings of the Club, conduct the correspondence thereof and have the custody of title-deeds and other documents belonging to the Club. He/She, instructed by the Committee, shall call an Ordinary and Extraordinary General Meetings. He/She, shall receive all money payable to the Club, and his/her receipt shall be sufficient discharge therefore. He/She shall also pay all Rents, Interest, Salaries, Taxes and Accounts due by the Club and incurred by the Committee, and shall keep correct accounts and books, showing the financial affairs and intromissions of the Club. Proper Accounts as at 31st December in each year shall be prepared by him/her, and after audit shall be submitted to the Committee for examination, and all money received shall be lodged in Bank to the credit of the Club excepting a reasonable balance for current outgoings; a Copy of the said Accounts shall be printed and forwarded to each Member and submitted to the Spring General Meeting.
(b) The Captain and Committee to acknowledge receipt of correspondence (whether by letter, fax or other electronic media) received from a member within three working days of receipt thereof and (save in exceptional circumstances) to provide a substantive response to said correspondence within 28 days or by the next convened committee meeting.
ELECTION OF MEMBERS
V The election of Members shall be in the hands of the Committee and shall be a majority decision. The Committee shall not proceed to the election of any Candidate until at least a fortnight shall have elapsed from the date of his/her application, and until his/her name and address, with the names of his/her proposer and seconder, one of whom must be responsible for his/her eligibility, shall have been posted for at least seven days on a conspicuous place in the Club Room. It shall, however, be in the power of the Committee to grant the privileges of the Club to a candidate until his/her election is confirmed.
- Membership is open to all and no application for membership will be refused on other than reasonable grounds. There will be no discrimination on grounds of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity race, religion or belief, sex; sexual orientation, political or other opinion.
The Club may refuse membership or expel from membership only for good and sufficient cause, such as conduct or character likely to bring the Club or sport into disrepute. Appeal against such a decision may be made to the Club’s members and decided by a majority vote.
ENTRANCE MONEY AND ANNUAL SUBSCRIPTION
VI Each new applicant for Full Membership shall, on admission, pay the Entrance Fee and Annual Subscription at that time in force. The Club Year commences on 1st January and ends on 31st December, but any New Member elected between 1st November and 31st December shall not be charged a subscription for the current year.
VII (a) On the admission of a New Member, the Secretary shall intimate the same to him/her, furnishing him/her with a copy of the Rules of the Club and requesting him/her to pay the amount of his/her Entrance Money and Subscription, and if the same be not paid within one calendar month from the date of such intimation, his/her election shall be absolutely void unless he/she shall show sufficient cause for such delay to the satisfaction of the Committee.
- A Member, on paying his/her Entrance Money and Subscription is thereby held
to have submitted himself/herself to the rules of the Club and on that condition alone is entitled to enjoy the advantages and privileges of the Club.
- Individuals under the age of eighteen shall be admitted to membership of the Junior Section on such terms as to payment and conditions of play as the Committee may from time to time determine. They shall be admitted to the Clubhouse but not the bar and shall have no vote. Boys or Girls who have been members of the Junior Section for two or more years shall, on attaining the age of eighteen be admitted to full membership without payment of the Entrance Fee.
VIII In the event of the subscription of any Member being in arrear on 1st April, his/her name may be posted in the Club Room if the Committee so decide, and in that event if his/her Subscription be not paid before 30th April, his/her name shall be erased from the list of Members of the Club, and he/she can only be re-instated by the consent of the Committee, and on payment of all arrears, including the subscription for each year since he/she fell into arrear.
IX Each Member shall communicate his/her address, and any subsequent change thereof, to the Secretary, and all notices sent to such address shall be considered as duly delivered.
- Within the various levels, membership is open to all regardless of race, colour, creed, disability or any other form of differentiation.

A bar levy shall be paid by all members other than those in categories junior and juvenile. The rate of levy shall be determined annually at the AGM when setting the annual subscription and shall be due and payable with that subscription. Members to pay same subscription rates within each category of membership. The amalgamation of gender groups together with the equalisation of subscription rates allows golfers the opportunity to join the Club on equal terms.
LIFE, HONORARY AND SOCIAL MEMBERS
X (a) Any Member who has paid his/her Entrance Money and First Year’s Subscription and is not in arrear with any subsequent year’s Subscription may become a Life Member on payment of Twenty times the Annual Subscription and provided the applicant has attained Thirty Years of age.
(b)On the recommendation of the Committee, Ordinary Members may, under special circumstances, be elected Life Members at any General Meeting of the Club, and shall thereafter be entitled to all the privileges of Membership, without paying the Annual Subscription or any special payments for such Life Membership.
(c)The Committee shall, under special circumstances have power to elect Honorary Members who shall be admitted to the Clubhouse and Green, but shall not be entitled to vote at Meetings or play for prizes. Only such persons as have attained pre-eminence in the Game of Golf or who have rendered special services to the Club or to the Community of Campbeltown or District, or in the promotion of the Game of Golf shall be elected Honorary Members.
(d) Any new applicant for Social Membership will be required to adhere to the same process as Rule V.
(e) Members with Twenty Years or more full subscription are eligible for a reduced subscription on attaining Sixty Five years of age.
XI Any Member absent from the United Kingdom during a whole year shall not be called upon for the Annual Subscription for that year. Before leaving he/she must intimate his/her intended absence, in writing, to the Secretary.
XII Any Member wishing to resign from the Club shall notify the same in writing to the Secretary previous to 1st January; in default of which he/she shall be liable for his/her Subscription for the year commencing on that day. Any ex-member who has so resigned wishing to rejoin shall be subject to re-election as provided for in Rule V, and the Entrance Money and Subscriptions payable by him/her shall be those payable by new Members admitted at the date of his/her re-election.
XIII Should the conduct of any member be, in the opinion of the Committee, injurious to the character and interests of the Club, the Committee shall require such Member to give an explanation of his/her conduct either in writing or in a personal appearance before the Committee as the Member may decide. Refusal or failure by such Member either to write to or appear before the committee shall leave the Committee free to act. The Committee shall therefore have power to suspend such Member from the Clubhouse and/or course for such period as the Committee may decide. Should the Committee consider the misconduct of any Member such as to justify expulsion from the Club, the Committee shall suspend such Member from the course and the clubhouse until the next Annual General Meeting. At such meeting the Committee shall submit the proposal for expulsion and should a vote be required the same shall be taken by ballot, and a two-thirds majority of those present and voting shall be required to carry the Committee’s proposal. On the proposal being carried, such Member shall cease to be a Member of the Club and shall have no claim on its property.
AFFAIRS OF THE CLUB
XIV The Committee shall be responsible for the good conduct of the affairs of the Club and shall have power to reprimand any Member for conduct injurious to the character and interest of the Club unless the Committee shall decide to proceed under Rule XIII hereof.
XV The property Effects and Monies of the Club shall belong to the Members, during The Membership equally; but the right and interest of every member shall be personal and limited to himself/herself, and shall expire with his/her Membership, and shall not be assignable or arrestable, nor pass to heirs or executors.
- The Income and Property of the Club shall be applied solely towards promoting the Club’s objects as set forth in this constitution and no portion thereof shall be paid or transferred, directly or indirectly, to the Members of the Club.
XVI Members of any recognised Golf Club may become Temporary Members of the Club on being duly introduced by a Member, or vouched for by the Secretary or his/her nominee, on such terms as may be arranged from time to time by the Committee, which terms may include all the usual privileges of the Club House and Course, and in the event of a Temporary Member becoming an Ordinary Member of the Club, any payments made by him/her during the year of his/her entry in terms of this rule shall be deducted from his/her Entrance Money and Subscription.
The Committee shall have the power to admit as Temporary Members, with or without payment, and with all the privileges of the Club House and Course, for one or more days, members of any other Golf Club or Association for the purpose of engaging in a Match or Competition. The names and addresses of all persons so admitted shall be posted in the Club House for three days previous to the match or competition, and attested by the signature of the Captain or Secretary.
The Committee may refuse the privilege of Temporary membership to any person whomsoever, and their decision on this point shall be final.
Temporary Members shall be subject to the authority of the Committee, any may have their privileges summarily suspended or withdrawn without reason given.
Temporary Members shall have no right of introduction to play on the course, or to the Club House, and they shall have no right or interest in the property of the Club.
They shall have no voice in the management of the Club’s affairs, and shall not play in the Club Competitions.
Rule V shall not apply to Temporary Members.
XVII Full Members, Country Members and Associate Members shall be entitled to introduce Guests to the Course. All members shall be entitled to introduce Guests to the Clubhouse provided he/she accompanies them and discharges any liability incurred by them, but the introduction of Guests to play Golf on the Course is subject to the following conditions:
- The name of every Guest must be entered in the Book kept for that purpose, and the entry signed and dated by the Member.
- No Full Member or Associate Member shall introduce a guest to the course on more than six days in any one year and no Country Member shall introduce a guest to the course on more than three days in any one year.
- A fee of £10 will be charged to introduce a Guest to the Course, No One Guest may be introduced more than Four Times in any one year.
- Guests shall not be supplied with excisable liquor in the Club premises unless on the invitation and in the company of a Member, and the Member shall upon the admission of such Guest to the Club premises, or immediately on his/her being supplied with such liquor, enter his/her own name and the name and address of the Guest in a book which shall be kept for the purpose, and which shall show the date of each visit.
- The Committee shall have the power to suspend the introduction of Guests at any Social function held by the Club.
XVIII Competitions shall be held at such times and under such conditions as the Committee shall determine. In the event of a Member not being able to obtain a Member of the Club to keep his score it may be kept by duly appointed marker.
XIX One Ordinary General Meeting of the Club shall be held, each year, at Campbeltown or Machrihanish, in Spring, at such time and place as the Committee shall determine. Twelve Members must be present to constitute an Ordinary General Meeting. Twenty-one days notice of such Meeting shall be sent to every member to his/her address in the Club Register. An Auditor shall be appointed at this meeting. A resolution carried at an Ordinary General Meeting or an Extra General Meeting shall take immediate effect.
XX The Committee may call an Extraordinary General Meeting of the Club whenever they think fit, and shall be bound to do so on receiving a requisition to that effect, signed by ten or more Members. Such requisition shall specify the measure or measures to be proposed to the Meeting in the form of a resolution or resolutions.
A Notice stating the resolution or resolutions to be put before the Meeting shall be advertised in the press at least fourteen days before the date of the Meeting. Twenty-One Members must be present to constitute an Extraordinary General Meeting; and no Resolution shall be valid unless it obtains the concurrence of two thirds of the Members present and voting.
CAPTAIN AND VICE-CAPTAIN
XXI The Captain (whom failing the Vice-Captain) if present shall preside at all Meetings of the Club and of the Committee. In their absence, the senior Member of Committee present shall preside. The Captain shall be the Convener of the Committee, and shall direct the Secretary to send written notice to each Member of the Committee when a Meeting is to be called. In the event of votes being equal at any Meeting, the Chairperson shall have a casting as well as a deliberative vote.
The Captain shall at all times have precedence at the first tee.
ALTERATION OF RULES
XXII No Rule of the Club shall be repealed or altered and no new Rule shall be made save by two-thirds of the Members present and voting at an Ordinary General Meeting; and one calendar month’s notice of the intention to propose any new rule, repeal or alteration shall be given to the Secretary, who shall send notice of the same to every Member to his/her address in the Club register at least twenty-one days before such Ordinary General Meeting; but if any ten members present shall by a written requisition delivered to the Chairperson at such Ordinary General Meeting demand a vote of the Club upon any question which shall have been submitted to such Meeting, relating to the alteration or repeal of any existing rule or the enactment of any new one, such question shall be decided by the majority of votes on voting papers to be forwarded to every member of the Club in the United Kingdom returnable within a fortnight of the date of issuing the same to the Members, such papers to be examined and reported on by scrutineers to be appointed by the Meeting.
XXIII All complaints shall be made in writing to the Secretary, who, if he/she should be unable to deal with them himself/herself shall submit them to the Committee, whose decision shall be final. In no instance shall a servant be reprimanded directly by a Member.
PRESIDENT OF THE CLUB
XXIV An Honorary President of the Club, who shall be an Ordinary, Life or Honorary Member, may be elected at any General Meeting, for a term of three years.
TRUSTEES OF THE CLUB
XXV The Trustees of the Club will be The Captain, Vice-Captain and Secretary who hold office at the time.
XXVI (a) The Club house shall be open to Members on such days and at such hours as shall be fixed by the committee.
(b) No notice or document of any kind shall be placed on the walls of the Club rooms except by authority of the Committee.
(c) No Member shall take or permit to be taken from the Club House any article belonging to the Club.
(d) No excisable liquor shall be sold or supplied in the Club premises for consumption off the premises except to a Member of the Club in person for consumption by him/her or to a person holding an excise licence for the sale of such liquor.

(e) No excisable liquor shall be sold or supplied to any person under eighteen years of age.
(f) The hours during which it is permitted to sell excisable liquor shall be as laid down in the Licensing (Scotland) Act in current use.
(g) Any major structural alteration, addition or removal on the course, in the clubhouse or other property of the club should be brought before a General Meeting of the Club for approval.
(h) All food and drink consumed within Club premises to be supplied by the Golf Club or Club Steward.
RULES OF THE GAME
XXVII The rules of the game of golf shall be those adopted from time to time by the Royal and Ancient Golf Club of St Andrews, subject only to such additions and modifications as the Committee consider necessary to meet the requirements of Machrihanish Golf Links.
XXVIII All profits or surpluses generated by Club activities shall be applied to the continuance, maintenance or improvement of Club facilities. In the event of the dissolution of the Club, any assets remaining after the satisfaction of all debts and liabilities shall not be paid to or distributed among the members of the Club, but shall be given or transferred to one or more of the following approved sporting or charitable bodies:
(1) A registered charitable organization(s).
(2) Another Club which is a registered CASC
(3) The sports national governing body for use by them for related community sports.
